FDA ISSUES IMPORT ALERT ON CANTALOUPES FROM MEXICO

The Food Drug Administration (FDA) has issued an import alert on cantaloupes from Mexico because of insanitary conditions that have resulted in four Salmonellosis outbreaks in the last three years in the United States. These outbreaks were responsible for many illnesses including two deaths and at least 18 hospitalizations. This import alert recommends that officials detain without physical examination cantaloupe from Mexico offered for entry at all U.S. ports.

Investigations of Salmonella outbreaks between 2000 and 2002 showed insanitary conditions in the growing and packing of cantaloupe in Mexico. In addition, FDA sampling of imported produce found some samples of cantaloupe from most growing regions in Mexico tested positive for Salmonella. The samples were collected during both the fall/winter and spring/summer season. Today's import alert expands the prior import alerts that targeted specific shippers and growers whose products were linked to outbreaks or tested positive for Salmonella.

The FDA also announced today that it will continue to work with the Mexican government on a food safety program for production, packing and shipping of fresh cantaloupes. The Mexican government has proposed a certification program based on good agricultural practices and good manufacturing practices that would allow FDA to identify firms that have adopted and implemented such a food safety program. This certification program is still under development.

FDA AND FBI MAKE ARREST IN TAMPERING INCIDENT IN THE ODESSA/MIDLAND TEXAS AREA

The Food and Drug Administration (FDA), Office of Criminal Investigations; Federal Bureau of Investigation (FBI); and the Odessa Police reported that an arrest had been made in the recent product tampering case involving Metaboloss Diet, Metaboloss Fat Burner and Vanquish brand acetaminophen. Sammy Joe Berry, age 31 of Odessa, TX was arrested on charges that include consumer product tampering under Title 18. The arrest was made at his home after a search warrant was executed and law enforcement officials found evidence suggesting that he was the sole person involved in the tampering incidents. The suspect is to be arraigned by a federal magistrate today.

"FDA appreciates the collaboration with the FBI, local authorities and the other organizations in bringing this case to a quick close," said Dr. Lester M. Crawford, FDA Deputy Commissioner. "This swift action today shows that unscrupulous individuals will be brought to justice," he said. Albertsons, Walgreens and Walmart provided assistance in the investigation. The potentially tampered products were located in their stores. FDA has recommended that persons who have recently purchased these products not consume them, but instead return them to the store from which they were purchased.

Problem: The products may be contaminated with Listeria monocytogenes.

Discovered: On October 03, 2002, FSIS collected samples from retail as part of an on-going food safety investigation of illnesses in the Northeastern United States. An intact sample was reported positive for Listeria monocytogenes by the FSIS Outbreaks Laboratory. The positive results strongly suggest that the recalled products may be linked to the source of the wide spread illnesses in the Northeastern US. Based on this information firm has voluntarily initiated the recall and suspended its operations.

NEW CHOICE AGREES TO WITHDRAW REMAINING GEL SNACKS ON US MARKET

The Food and Drug Administration (FDA) and New Choice Food Inc., a distributor of conjac gel candies, have entered into a consent decree which will lead to the FDA-supervised destruction of 13,000 cases of mini-cup gel candies containing the ingredient conjac. This is the latest in a series of actions the agency has taken to protect the public against conjac gel candies, which pose an unacceptable choking hazard.

Conjac gel candies are typically packaged as individual, mouth-sized servings in several fruit flavors. Each gel cup is about the size of a single-serve coffee creamer. Various brands of conjac candies have been associated with the choking deaths of children.

Under the terms of the consent decree with New Choice, conjac gel candies that were seized by the United States, valued at approximately $500,000, will be destroyed. New Choice has also agreed to withdraw adulterated and misbranded products like those seized that may still be on the market. The company has posted a penal bond of $800,000 as assurance that it will meet the terms of the consent decree.

The decree states that New Choice must present for FDA approval a written product withdrawal plan. FDA will supervise the withdrawal and the destruction of the seized items. New Choice is responsible for the costs that the government may incur under the consent decree.

A history of conjac candy recalls and FDA's alerts is available at: http:www.fda.gov/oc/firmrecalls/topics/konjac.html.
